Overdue Payments
how soon an overdue payment is reported to collection agency?
I had an account with a utility company for 4 years making payments on time for each month. The last bill was either lost in the mail or whatever happened, I didn’t receive it. The company never communicated with me about the last bill and about 3 months later, I received a letter from a collection agency for only 40 dollars! They tarnished my credit history. Is this fair? Can they give me to collection without notifying me? And what is the time period between a debt becoming overdue and giving it for collection? If this is unfair how can I seek justice?
A collection agency can report a so called bad debt to your credit report at anytime. However given your situation I would say that this is not fair and I would write a letter to the Utility company, the creditor and the Credit reporting agencies explaining the situation and ask them to remove this item from your report as this can be done any time as well. Enclosed in your letter I would provide copies of your previous bills showing that this was a error and that you have not been late ever before. One additional thing that I would add in the letters is a deadline that you expect them to communicate some resolution to you. Otherwise if you do not do this then they can take as long as they want to correct this issue.
